Doctor accused of allegedly defrauding pastor

A former dental surgeon at Mulago Hospital in Kampala City has been charged with giving false information and issuing false documents over land in the city.

Ntwatwa Sikiziyivu Lule, 64, is charged along with businessman Stuart Mulangira Katerega, 55. Ntwatwa is a resident of Agrey area of ​​Ndeba Parish, Lubaga Division, Kampala District, while Katerega resides in Munyonyo, Makindye Division of Kampala.

Appearing before Legal Development Center (LDC) Court First Magistrate Martins Kirya on May 6, 2024, Ntwatwa denied the charges.

His co-accused, Katerega, failed to appear in court, prompting the magistrate to issue a criminal summons against him.

The duo are accused of giving false information to a person employed in the public service, in violation of Article 115 of the Penal Code Law; conspiracy to defraud, in violation of article 309 of the same law; and issuing false documents, in violation of article 351 of the same law.

The crimes carry three years in prison upon conviction.

Defense lawyer Umaru Nyanzi asked the court to grant bail to Ntwatwa and he was released on non-monetary bail of Sh500,000 after submitting substantial assurances to the court.

The prosecution led by Timothy Aduti alleges that in 2019 at Wandegeya Police Station, Kawempe Division, Kampala, Ntwatwa and Katerega gave a police officer information, which they knew or believed to be false, that they were the rightful owners of the ‘ kibanja’ in front of the Government. Analysis Laboratory at Mulago Roundabout, Kimwanyi Area, Kasule Road.

The prosecution further alleges that the duo conspired to defraud Pastor Daniel Walugembe of his kibanja in front of the Mulago Government Analytical Laboratory roundabout by claiming to have purchased it from Bulasio Bwiso in the early 1990s.

According to the complaint, Walugembe purchased 15 acres of land in 1996 from Bwiso, Jonathan Masembe, among others, but the accused allegedly took over one acre of his land.

The prosecution also alleges that on 17 September 2020 at Wandegeya Police Station, the accused (Ntwatwa), knowingly and fraudulently issued false documents, namely ‘busulu’ receipts (land rental receipts) to police officers. police, which were supposedly issued to him by the family of Ashe Sendawula Mukasa.
